Coaching Confidentiality Terms

At Larkspur Wellness LLC (“Larkspur Wellness,” “we,” “us,” or “our”), trust and discretion are important parts of the coaching relationship. These Coaching Confidentiality Terms are intended to create a clear, mutual understanding about how private and confidential information shared during our work together will be treated.

1. Our Commitment to Your Confidentiality

Information you share with Larkspur Wellness in connection with coaching services will be treated as confidential and will not be disclosed to others except:

  • with your permission;

  • as reasonably necessary to provide or administer the services you have requested;

  • when the information is already publicly available through no breach of these terms; or

  • when disclosure is required by applicable law, legal process, or a valid governmental or court order.

We will use reasonable care to protect confidential information you share with us.

2. Your Commitment to Confidentiality

During the course of coaching, Larkspur Wellness may share information that is private, proprietary, or developed specifically for its coaching practice.

You agree to keep confidential any non-public proprietary or confidential information provided to you, including business information, unpublished materials, methodologies, exercises, frameworks, processes, resources, and other information that is identified as confidential or that a reasonable person would understand to be confidential.

You may use materials provided to you for your own personal use in connection with your coaching experience. Unless we give you permission, you may not reproduce, publish, distribute, sell, teach, or otherwise make our proprietary materials available to others.

3. What Is Not Confidential

These confidentiality obligations do not apply to information that:

  • is or becomes publicly available without a violation of these terms;

  • was lawfully known to the receiving party before it was disclosed;

  • is lawfully received from another source without a confidentiality obligation;

  • is independently developed without use of the other party’s confidential information; or

  • is disclosed with the other party’s permission.

4. Recording and Sharing Sessions

Neither party may record a coaching session without the knowledge and consent of the other party.

You also agree not to publish, distribute, or publicly share recordings, transcripts, screenshots, or substantial portions of private coaching communications without our prior permission.

5. Required Disclosures

Nothing in these terms prevents either party from making a disclosure that is required by applicable law, regulation, subpoena, court order, or other legally binding process.

When legally permitted and reasonably practicable, the party required to make the disclosure should limit the disclosure to the information legally required.

6. Duration

These confidentiality obligations continue after an individual coaching session and after the coaching relationship ends for as long as the information remains confidential or proprietary.

7. Coaching and Professional Services

Coaching services provided by Larkspur Wellness are governed by any additional terms, policies, informed-consent materials, or service agreements presented in connection with the applicable service.

These Confidentiality Terms do not create a physician-patient, therapist-client, attorney-client, or other professional relationship that does not otherwise exist, and they should not be interpreted as creating a legal privilege where applicable law does not provide one.

8. Acceptance of These Terms

By scheduling, purchasing, or participating in coaching services after being provided access to these Coaching Confidentiality Terms, you acknowledge that you have had an opportunity to review them and agree to be bound by them.

No separate signature is required where these terms are accepted through the applicable booking or purchasing process.
